INDEMNIFICATION POLICY:
You agree to use all Smart SEO VPS services and facilities at your own risk. Smart SEO VPS specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Smart SEO VPS be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Smart SEO VPS harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Smart SEO VPS, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Smart SEO VPS against liabilities arising out of any injury to person or property caused by any products sold or otherwise distributed in connection with Smart SEO VPS’s server.
Smart SEO VPS reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from Smart SEO VPS’s server. Smart SEO VPS shall be the sole judge of what violates this Policy.
BILLING:
We bill monthly as well as have bulk month purchasing options on some VPS, if you are looking to buy bulk months together then you can get a good discount, you can check all the plans in the Shop. We hold the right to change the price i.e increase or decrease it anytime with or without any prior notice. If the delivered service is not as described on our order pages, we would be happy to provide you with a full refund within your first day (24hrs only) of purchase.
If your server IP address is banned for spamming, you will not receive a refund under any circumstances. No refunds would be offered during any of the special promotional offers where the prices are discounted. (For some special offers the money-back-guaranteed day may be varied).
All Dedicated Servers are not refundable under any circumstances once delivered.
We own the right to run and withdraw special promotions, coupons etc. anytime we want. Coupon is usually valid just during the first payment but we may have some special coupons which may be valid for more than one payment cycle. We do not store your credit card / net banking details everything is done is secured third party environment of the payment gateway provider and we are not responsible if anything happens from their side.

No refunds on VPS renewals or any other product present on our site on any condition. We guarantee only 60 – 70% tools to be working at any moment.
No refunds on funds / credits added to the account on any condition. They can only be used for purchases or renewals. Overpayment / Duplicate payments are automatically added in account credits, if customer claims for refund within 24hrs then they can be refunded back to their original payment method. No refunds after 24hrs, they can only be used for future purchases or renewals.
No refunds if any tool stops working. If you are here for just single tool then kindly don’t purchase.
*No refunds if you have already purchased in past or claimed refund, refunds are limited to just 1 time for new customer account. Duplicate accounts just to claim refunds will result in ban of all the services without any refunds.
LATE PAYMENTS:
All accounts are billed according to the dates they were first activated on. If you will not pay for service renewal then on due date the VPS will be suspended and 4 days after the due date your VPS will be auto-terminated by the system. We are not held responsible for the deletion of the date from the server as data can’t be recovered from a terminated server. Also we cannot provide you any backups without renewal if the server payment is due and is suspended, in order to get the backup you need to renew to release the hold.
ACCEPTABLE USE POLICY:
All services provided by Smart SEO VPS may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to copyrighted material, a material we judge to be threatening or obscene, or material protected by trade secret and other statutes. The subscriber agrees to indemnify and hold harmless Smart SEO VPS and its employees from any claims resulting from the use of the service which damages the subscriber or any other party.Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all Smart SEO VPS servers. This includes sites that include sexually explicit or hardcore images and/or advertising.

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.
Subscriber further acknowledges that the company’s liability for its own negligence may not, in any event, exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material.
Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez, and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.
LIMITATION OF LIABILITY:
Smart SEO VPS shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Smart SEO VPS servers going off-line or being unavailable for any reason whatsoever. Furthermore, Smart SEO VPS shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Smart SEO VPS servers. All damages shall be limited to the immediate termination of service.
* IMPORTANT: Client is responsible for providing installation software and keys/licenses for ALL Microsoft and third-party software required to be installed, if not purchased through Smart SEO VPS.
DISCLAIMER:
Smart SEO VPS cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Smart SEO VPS are resold. Thus, certain equipment, routing, software, and programming used by Smart SEO VPS are not directly owned or written by Smart SEO VPS. Moreover, Smart SEO VPS holds no responsibility for the use of our clients accounts.
If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Smart SEO VPS sees fit. FURTHERMORE, Smart SEO VPS retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
MISUSE OF VPS (MINING/VIRUS/TROJANS):
If we find that you are using the VPS for Crypto Currency Mining or using any DDOS tool or any hacking or virus tool then your VPS will be immediately suspended and a penalty may be levied in order to un-suspend the service, if misused again then your VPS will be terminated with complete deletion of your server data and no refund will be provided.
CAUSING TROUBLE TO OTHERS:
We have automated monitoring bots as well as manual routine check, if there is over use of CPU or storage on the Level 1 and 2 shared servers, which spoil other users experience / restricts the server to function normally, then we reserve the right to delete the over used data or close the programs in case of high CPU usage or even suspend the service, we are not responsible for loss of any unsaved work / data in such case, upon suspension a penalty may be levied in order to un-suspend the service, if the misuse continues then your VPS will be terminated with complete deletion of your server data and no refund will be provided.
PAYPAL CLAIMS / DISPUTE CASES:
Once placed an order on the site it is being delivered within 24 – 48 hours max and in worst cases can take up to 72 hours and if there is some issue which will result in order delivery being late then we will mail the buyer regarding it and accordingly his order date will be adjusted. Refund period starts after the server delivery mail is being sent to the buyer, refund period is 24hours for Level 1 and Level 2 server only and no refund on any other product or renewal payments on any condition. Orders are delivered by mail so no tracking info is provided just inside your account you can see your order/service status, once the order/service status shows completed/active then you need to check your registered email inbox for the order details if not found there then check the spam box as sometimes emails end up being there which is not in our control. If you fail to check it then it’s your mistake, no days extension on service will be given in such case.
By placing the order on the site you Agree to all the terms and conditions mentioned on this page and no claims or dispute cases shall be entertained in your favor, if you open a case even after accepting the terms & conditions then you agree that PayPal shall close the case in our i.e sellers favor instead of buyers / customers favor and we will terminate the VPS without refund.
We may ask you to verify your identity to avoid frauds, so you must submit a scanned copy of government authorized non-confidential document which has name matching your transaction name and if we find that the government proof provided by you is fake or not matching your account details provided on our website then we hold the right to terminate your order or account if failed to verify your transaction, without any prior notice and no refund shall be given in such situation.
